1. Purpose
This Copyright & Intellectual Property Policy explains how JOMP respects intellectual-property rights and how users may upload, use, report and manage copyrighted materials on the JOMP platform.
JOMP does not permit users to upload or use copyrighted material in a manner that infringes another person's or organisation's rights.
2. What Is Copyright?
Copyright is a legal protection that may apply to original creative works, including certain:
- written materials;
- photographs;
- graphics;
- videos;
- software;
- artwork;
- music and audio;
- website content;
- presentations; and
- other original creative works.
Copyright ownership generally belongs to the creator or another person or organisation to whom the rights have been legally transferred or licensed.
3. User-Uploaded Content
Users may upload materials to JOMP where they:
- own the relevant intellectual-property rights;
- have received permission or a licence to use the material; or
- are otherwise legally entitled to upload and use the material.
Examples may include:
- CVs;
- portfolios;
- photographs;
- certificates;
- professional documents;
- company logos;
- job descriptions;
- vacancy materials; and
- other content submitted through JOMP.
4. Candidate Content
Candidates remain responsible for ensuring that materials they upload do not unlawfully infringe another person's intellectual-property rights.
A candidate should not upload:
- another person's CV as their own;
- copyrighted portfolio work they have no right to use;
- stolen photographs;
- unauthorised company materials; or
- other protected materials without permission.
Where a candidate's portfolio contains work created while employed by another organisation, the candidate should ensure that they have the necessary rights or permission to display the work.
5. Employer Content
Employers are responsible for ensuring that job descriptions, company logos, photographs, graphics, videos and other materials uploaded to JOMP are used lawfully.
An employer must not upload content that it has no right to reproduce, distribute or display.
6. Licence to JOMP
By uploading content to JOMP, you grant JOMP a limited, non-exclusive, royalty-free licence to host, store, reproduce, display and process that content only as reasonably necessary to:
- provide JOMP's services;
- display a candidate's application to an employer to whom the candidate applied;
- display vacancies;
- operate candidate and employer profiles;
- provide CV and assessment services;
- maintain backups and security;
- improve the platform; and
- comply with legal obligations.
This licence does not transfer ownership of the user's copyright to JOMP. The licence ends when the content is deleted, except where continued retention or use is reasonably necessary for legal, security, dispute-resolution or technical purposes.
7. JOMP's Intellectual Property
Unless otherwise stated, JOMP owns or has appropriate rights in the intellectual property associated with its platform, including:
- JOMP's name and branding;
- logos created for JOMP;
- website and application interfaces;
- software and source code;
- databases;
- platform architecture;
- original graphics;
- platform documentation;
- proprietary systems;
- original platform content; and
- other materials created specifically for JOMP.
Users must not copy, reproduce, modify, distribute, sell, reverse engineer or commercially exploit JOMP's proprietary materials without permission.
8. Third-Party Intellectual Property
JOMP may use third-party software, services, fonts, libraries, APIs, images or other materials under licences. Those materials remain subject to the rights and licence conditions of their respective owners.
9. Copyright Complaints
If you believe that material available through JOMP infringes your copyright, you may submit a copyright complaint to:
Copyright Email: jomponline.mail@gmail.com
A complaint should include:
- your full name;
- contact information;
- identification of the copyrighted work;
- identification of the material you believe infringes your copyright;
- information sufficient for JOMP to locate the material;
- an explanation of why you believe the material infringes your rights;
- evidence of ownership or authority to act on behalf of the rights holder; and
- a statement confirming that the information provided is accurate.
10. Review of Complaints
JOMP may review copyright complaints and take appropriate action where it reasonably determines that action is necessary, including content restriction, removal, user communication, or account suspension/termination.
11. Counter-Notification
Where appropriate, a user whose content has been restricted or removed may contact JOMP to explain why the material was uploaded lawfully. JOMP may restore content where it determines that restoration is appropriate and legally permissible.
12. Repeat Infringement
JOMP may restrict or terminate accounts belonging to users who repeatedly infringe copyright or other intellectual-property rights.
13. False Complaints
Users must not submit knowingly false or misleading copyright complaints. JOMP may take action against users who abuse the copyright-reporting process.
14. Trademark Rights
Copyright is separate from trademark rights. JOMP respects trademarks belonging to employers, candidates and third parties. Users must not upload or use another organisation's trademark in a misleading manner or falsely imply an affiliation with that organisation.
15. Reporting Other Intellectual-Property Infringement
The same reporting channel may be used to report suspected infringement of other intellectual-property rights, including trademarks, trade names, and proprietary designs.
16. No Transfer of Ownership
Uploading content to JOMP does not automatically transfer ownership of that content to JOMP. Users retain their rights subject to the limited licence described in this Policy and the JOMP Terms of Service.
17. Changes to This Policy
JOMP may update this Policy when its services, intellectual-property practices or applicable legal requirements change.
